SimpliSafe Guidelines for Law Enforcement Requests

We respond to requests for customer account information in accordance with applicable law, such as the Electronic Communications Privacy Act (“ECPA”), which subjects providers of electronic communication and remote computing services, like SimpliSafe, to various legal restrictions on the disclosure of customer data. All requests are also subject to SimpliSafe’s Terms of Sale, Terms of Service, and Privacy Policy. These Guidelines, and the processes set forth in them, are subject to change from time to time.  

HOW TO SUBMIT A REQUEST

Please complete the appropriate online form linked below, depending on the nature of your request. This form must be completed to process your request.  

Before submitting the relevant form, please review the information below about the data that SimpliSafe maintains and the requirements for producing that data.

A search warrant, court order (issued pursuant to 18 U.S.C. § 2703(d)) or a SimpliSafe Authorization & Release form signed by the verified account holder (in accordance with SimpliSafe’s authorization and release process) is required for production of Account Content Data beyond Subscriber Information as described below.

AVAILABLE DATA & REQUIREMENTS FOR PRODUCTION

Depending on the nature of the customer’s account and service plan, SimpliSafe is only able to provide the following types of account data in response to lawful requests, as set out below.

NON-LAW ENFORCEMENT REQUEST

  • Individuals and attorneys involved in litigation to which SimpliSafe is not a party, or a criminal matter, should obtain the information sought directly from SimpliSafe’s customers, as party discovery is the most appropriate and efficient means of obtaining data in this context.

  • In most circumstances, SimpliSafe’s customers have access to the same relevant data as SimpliSafe (e.g., system video recordings, system event timeline).

  • Subpoenas must be properly executed and served on SimpliSafe via its Registered Agent (if outside of Massachusetts) or in accordance with the Massachusetts Rules of Civil or Criminal Procedure, as applicable.  

  • Subpoenas must also provide information sufficient to specifically identify the relevant SimpliSafe customer, the relevant types of customer data available from SimpliSafe, as set out in SimpliSafe’s Private Attorney Request Form (Non-Law Enforcement) above, and the specific and narrowed date and time range (including relevant time zone) of the requested data.

  • Please note that the law prohibits SimpliSafe from producing certain information in civil litigation.  See, e.g., 18 U.S.C. § 2702. 

SimpliSafe may seek reimbursement for costs associated with producing information as permitted by law (e.g., under 18 U.S.C. § 2706).

AVAILABILITY OF SYSTEM VIDEO/AUDIO DATA

  • For video data to be available for production, the customer must subscribe to a service plan that includes video recordings. Otherwise all cameras on a customer’s system are live view only. 

  • SimpliSafe does not maintain any system audio recordings for customer security systems that are separate and distinct from system video recordings.

  • For 30 days after recording, videos are available to customers in their accounts for download unless they delete the video during that time.

  • SimpliSafe does not know the location within the premises of any SimpliSafe system cameras.

PRESERVATION REQUESTS BY LAW ENFORCEMENT/GOVERNMENT ENTITY

  • We will take steps to preserve records and other evidence in SimpliSafe’s possession for 90 days upon request of a government entity, pending our receipt of formal legal process. Such data can be preserved for an additional 90 days upon additional written request.

  • You may submit formal preservation requests by submitting the Law Enforcement/Government Entity Request Form (Non-Emergency) 

EMERGENCY REQUESTS BY LAW ENFORCEMENT

  • For emergencies involving danger of death or serious physical injury to any person and requiring disclosure of information without delay, only law enforcement officials may submit a request via the Emergency Law Enforcement Request Form  

IMPORTANT! SimpliSafe will not review or respond to requests using the Emergency Law Enforcement Request Form by non-law enforcement officials. Non-law enforcement requestors aware of an emergency situation should immediately contact their local law enforcement officials.

ALL REQUESTS

  • For law enforcement/government entity requests, acceptance of legal process via mail, email from a government email address or other electronic means is for convenience and does not waive any objections, including lack of jurisdiction or proper service.

  • SimpliSafe may seek reimbursement for costs associated with information produced pursuant to legal process and as permitted by law (e.g., under 18 U.S.C. § 2706).

  • To ensure SimpliSafe can carefully assess each request in accordance with these Guidelines, we require the request to allow for a reasonable turnaround time frame to investigate the request and furnish a response. SimpliSafe will not be able to respond to requests that do not afford it a reasonable amount of time to diligently comply with these Guidelines and applicable law.

  • We do not retain data for law enforcement/government entity purposes unless we receive a valid preservation request.

  • In response to valid requests received in accordance with these Guidelines, we will search for and disclose data that:

    1. Is specified with particularity in an appropriate form of legal process

    2. Is in our possession, and 

    3. We are reasonably able to locate and retrieve.
